Terms of Service

1 Acceptance of Terms

By accessing or using SereChat, a product of Luvarly, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to any part of these terms, you may not use our platform.

2 Eligibility

You must be at least 18 years or the age of majority in your jurisdiction of age to use SereChat. By signing up and using the platform, you legally confirm you meet this age requirement.

3 User Conduct

You agree not to use the platform to:

• Generate, share, or promote illegal content, including but not limited to CSAM (Child Sexual Abuse Material), non-consensual intimate imagery, or content promoting terrorism.
• Harass, threaten, or incite violence against real people or groups.
• Attempt to bypass security measures, reverse-engineer the API, scrape content, or disrupt the service (e.g., DDoS attacks).
• Use the service to violate any applicable law or regulation.

4 AI-Generated Content & Limitations

SereChat utilizes third-party AI models to generate text, images, audio, and other content. You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, or misleading. The AI can "hallucinate" facts that are not true.
• AI-generated content does not represent the views, opinions, or endorsement of Luvarly.
• You should not rely on AI-generated content for medical, legal, financial, or other professional advice.
• Luvarly is not liable for any decisions, actions, or consequences arising from your use of or reliance on AI-generated content.
• AI outputs may occasionally produce content that is unexpected, inappropriate, or objectionable despite our safety measures.

5 Data Processing & Third-Party AI Providers

By using SereChat, you acknowledge and consent to the following:

• Third-party processing: Your chat messages, conversation context, and any attached files are transmitted to third-party AI model providers for processing. The specific provider depends on the model you select, and the model name is displayed in the interface.
• Potential training use: Some AI model providers may use data submitted to their APIs to improve, fine-tune, or train their models unless explicitly opted out. While many major providers state they do not train on API data by default, policies vary and are subject to change. We recommend you do not share sensitive personal information in chats.
• Media generation: When you use image, SVG, music, or video generation features, your prompts and any reference files are sent to third-party generation services.
• International transfers: Your data may be processed in jurisdictions outside your country of residence, including the United States and other countries. Some AI model providers may be based in jurisdictions with different data protection standards.

6 AI Provider Processing

SereChat no longer supports customer-supplied API keys or tokens. Requests to chat and generation features are processed using SereChat-managed provider accounts and infrastructure.

• Your data may be sent to the model or media provider needed to fulfill the feature you selected.
• Provider-specific terms and privacy practices still apply to the underlying processing of those requests.
• We may change providers over time to operate the service, but we remain responsible for the SereChat product experience exposed to you.

7 Your Data Rights (EU/EEA Users)

If you are located in the European Union or European Economic Area, you have specific rights under the GDPR:

• Data Portability: You can export all your data at any time from Settings > Account > Export My Data.
• Right to Erasure: You can permanently delete your account and all associated data from Settings > Account > Delete Account. This action is immediate and irreversible.
• Access & Rectification: You can view and update your profile data from Settings at any time.
• Withdraw Consent: Where processing is based on consent, you can withdraw it at any time via Settings.

8 Intellectual Property

The code, design, and branding of SereChat are the intellectual property of Luvarly. You retain ownership of the original prompts and character concepts you create, but grant us a non-exclusive, worldwide license to process, store, and display them as necessary to provide the service. This license terminates when you delete the relevant content or your account.

9 Payments & Subscriptions

Paid features (Pro and Ultimate plans, spark packs) are billed through Stripe. By purchasing a subscription or sparks:

• You authorize recurring charges for subscription plans until you cancel.
• Sparks are non-refundable once used for AI interactions or media generation.
• Subscription benefits (including increased usage and weekly allocations) are non-transferable.
• You can manage or cancel your subscription at any time through the billing portal.

10 Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violating these Terms, including generating prohibited content, abusing the API, or engaging in fraudulent activity. Upon termination for cause, you forfeit any remaining sparks or subscription benefits.

11 Disclaimer of Warranties

SereChat is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure at all times.

12 Limitation of Liability

To the fullest extent permitted by law, Luvarly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, loss of profits, or damages resulting from reliance on AI-generated content. Our total aggregate liability shall not exceed the amount you have paid to us in the 12 months preceding the claim.

13 Governing Law & Dispute Resolution

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of SereChat shall be submitted to the competent courts in the Netherlands. For users in the EU/EEA, nothing in these Terms affects your statutory rights under applicable consumer protection laws, and you may bring proceedings in the courts of your country of residence.

14 Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or an in-app notice at least 30 days before taking effect. Continued use of SereChat after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you must discontinue use and may delete your account.
